1. Acceptance of Terms

By accessing or using xixisusu ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

xixisusu is a web-based tool that allows users to create short 6.66-second video memes from audio recordings. The service includes recording, video generation, sharing, and downloading functionality.

3. User Responsibilities

As a user of xixisusu, you agree to:

• Use the service only for lawful purposes
• Not upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Not upload content that infringes on intellectual property rights
• Not attempt to interfere with or disrupt the service
• Not use automated methods to access the service

4. Content Ownership

• Your Content: You retain ownership of the content you create using xixisusu
• License to Us: By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and distribute your content through our service
• Our Content: The xixisusu platform, including its design, code, and branding, is owned by us and protected by intellectual property laws

4.1 Voice Rights Declaration

By uploading audio content to xixisusu, you declare and warrant that:

• Your Own Voice: The voice in the recording is your own, OR
• Authorized Voice: You have obtained explicit, documented consent from the person whose voice appears in the recording
• No Unauthorized Cloning: The content does not contain voice cloning, deepfake audio, or synthesized voices of real persons without their consent
• Legal Compliance: Your use complies with Taiwan's Personal Data Protection Act (個人資料保護法) and applicable voice/personality rights laws

You acknowledge that voice is considered personal data and biometric information under various jurisdictions. Unauthorized use of another person's voice may result in civil and criminal liability.

4.2 Public Content Authorization

When you choose to share content publicly on xixisusu, you understand and agree that:

• Public Access: Your content will be accessible via a public URL that anyone can view and download
• Download Permission: Other users may download copies of your publicly shared content for personal, non-commercial use
• Attribution: We recommend but do not require attribution when others share your content
• No Revocation: Downloads that occurred before you delete or make content private cannot be retrieved
• License Grant: You grant a non-exclusive license allowing viewing, downloading, and personal use of your public content

Important: If you do not wish your content to be publicly downloadable, do not use the public sharing feature. Use direct file download to your device instead.

5. Platform Rights

We reserve the right to:

• Remove any content that violates these terms
• Automatically delete anonymous uploads after 7 days
• Suspend or terminate access for users who violate these terms
• Modify or discontinue the service at any time
• Set and enforce usage limits

6. Data Retention

Anonymous uploads are automatically deleted after 7 days. We do not guarantee permanent storage of any content. Users should download their videos if they wish to keep them.

7. Prohibited Content

The following types of content are strictly prohibited:

• Illegal content or content that promotes illegal activities
• Sexually explicit content
• Violent or graphic content
• Hate speech or discrimination
• Personal information of others without consent
• Spam or commercial advertising
• Malware or harmful code
• Unauthorized Voice Content: Voice recordings of others without their consent, including but not limited to secretly recorded conversations
• Deepfake Audio: Synthesized or cloned voices of real persons created without their explicit consent
• Impersonation: Content intended to deceive others about the identity of the speaker
• Fraudulent Content: Audio designed to mislead, scam, or defraud others
• Defamatory Content: False statements that harm the reputation of identifiable individuals

8. Copyright Infringement (DMCA-Style Process)

We respect intellectual property rights and respond to valid takedown notices.

8.1 Filing a Takedown Notice

If you believe content on xixisusu infringes your copyright or voice rights, send a notice to [email protected] containing:

• Your contact information (name, email, phone number, address)
• Identification of the copyrighted work or voice recording claimed to be infringed
• The URL or identification of the infringing content on our platform
• A statement that you have a good faith belief the use is not authorized
• A statement, under penalty of perjury, that the information is accurate and you are the rights owner or authorized to act on their behalf
• Your physical or electronic signature

8.2 Response Timeline

We will review valid notices within 48-72 hours and remove infringing content promptly. Repeat infringers will have their access terminated.

9. Platform Safe Harbor

xixisusu operates as a neutral platform and user-generated content host. We are not responsible for:

• Content created, uploaded, or shared by users of the service
• How users choose to use content downloaded from the platform
• Third-party claims arising from user-generated content
• Disputes between users regarding content ownership or rights

Users who upload content bear full responsibility for ensuring they have the rights to share such content. The platform will cooperate with valid legal requests and DMCA-style takedown notices.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. THIS INCLUDES BUT IS NOT LIMITED TO DAMAGES ARISING FROM USER-GENERATED CONTENT, THIRD-PARTY CLAIMS, OR MISUSE OF DOWNLOADED CONTENT.

12. Indemnification

You agree to indemnify, defend, and hold harmless xixisusu, its operators, affiliates, and partners from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the service; (b) content you upload or share; (c) your violation of these terms; (d) your violation of any third-party rights, including voice rights, personality rights, or intellectual property rights.

13. Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms. We recommend reviewing these terms periodically.

14. Governing Law

These terms are governed by the laws of Taiwan, Republic of China. Any disputes shall be subject to the jurisdiction of the courts in Taiwan.
